Illinois Digs Deep to Pay ESA's Legal Expenses

$510,528.64

No, that's not GamePolitics' daily take from readers clicking on those little Amazon ads. The figure actually represents the amount the State of Illinois must reimburse the video game industry for legal fees incurred fighting Gov. Rod Blagojevich's failed video game law, ruled unconstitutional by a Federal District Court judge last December.

"Judge Kennelly's rulings send two irrefutable messages," said ESA boss Doug Lowenstein. "Not only are efforts to ban the sale of violent video games clearly unconstitutional, they are a waste of taxpayer dollars. The sad fact is that the State of Illinois knew this law was unconstitutional from the beginning. Taxpayers have a right to know that over half a million of their dollars and countless government hours were thrown away in this fruitless effort."

An Illinois legislator agreed.

"I am very disappointed that the state of Illinois has to pay these fees for what was such a clearly unconstitutional law from the start," said State Senator John Cullerton, like Gov. Blagojevich, a Democrat. "When I spoke against the law in Springfield, I predicted we would have to pay legal fees. The amount ordered paid to the plaintiffs... doesn't even count the substantial fees the state will have to pay its own lawyers."

By the way, don't get the idea that Sen. Cullerton is simply abandoning a sinking ship. As GamePolitics reported in May of 2005, Cullerton was always opposed to the video games bill, saying, ""This isn't about a law. This is about polling and press conferences."

Well, basically this is the price they have to pay for writing these laws. And right now, I think the people aren't gonna be happy about it.

I think the "cares" is correct. I think if everyone knew that their government just had to pay back .5 million dollars, they'd start reacting. It's the fact that these pieces of information aren't covered.

There is this big push by lawmakers all over this country to "protect children" by introducing laws concering the sale of video games. Now they have wasted at least half a million dollars on this. They want to protect children? How about spending the half million dollars on education? How about medicine for poor children? How about putting it into parks and after school programs? No, those won't improve the lives of children. Wasting time on absurd laws will.

Get re-elected; or, get put in jail due to corruption which may or may not have been found during your residency;
Repeat until corruption is found and tried.

Half a Million for deciding to fight against a law even laymen considered unconstitutional. Wonder what the good citizens of the State of Illinois will think of this.

These State Senators just pulled a fast one on Illinois tax payers.

They used $500K of tax payers' money for campaigning.

Sadly I don't live in Illinois, but if I did, I'd try my hardest to get these legislators sued for fraud or campaigning law infractions.

The lawmakers themselves may be immune to liability for their bad decisions. However, their re-election campaigns may not be. A case might be made that the only justification for passing these laws was to create the illusion that the lawmakers who vote for it "care about children" or are "family friendly". Thus the lawmakers could be said to be intentionally defrauding the people of their state in order to get re-elected. Perhaps the people of the state could recover the lost money by a class action suit against the re-election campaigns (which are likely to have far more money than the lawmaker him or herself) and start with an injunction to freeze the lawmaker's shared liability in suit.

Wouldn't it be funny as hell if they up and went and donated that back to their state as donation to childern's needs?

Schools hospitals....care...you name it...

It would make them look even worse because "voilent game industry" donated money for a needy cause rather wasted like the state did.

Nice, but given the recent "demise of E3 as we know it", the ESA may actually need the payment from the state in order to cover legal costs.

Since this is the second state that has had to pony up in this round of passing bad laws for re-election PR value, perhaps other states will catch the clue that they are looking at easily a million dollars in legal fees (their expenses plus paying ESA's fees) each time they are able to pass an unconstitutional law of this sort.

If we only knew how much these 'democratic' governments of ours waste every day, I am sure there would be politicians indicted every day. The problem is that, for the most part, people simply don't care. And because most don't care, the media will not investigate/uncover/report government corruption, waste, etc.

I live in Canada, which is the most corrupt of them all. A federal party was discovered to have illegally misappropriated taxpayer money twice but they almost WON the following election. Of course, no party official was indicted at all. That taught me something I really would not have wanted to learn AND it made up my mind about 'democracy', 'governments' and the uneducated masses that elect these lying fools.

Now I simply see the government as a mob family - I pay up my envelope every two weeks in order to keep earning and I hope the higher ups don't come down on me. I won't bother with anything else.

Personally, I am convinced that the smartest thing western governments did was to force income tax deductions at source. If people had to write a cheque to the government every year and SAW that money leaving their hands, then they would care how it was being spent.

I live in Illinois. Our govener is one of the stupidest people I have ever seen in politics. He is taking credit for all kinds of projects his predicessor put into play, he is introducing stupid legislation (like the above). He has cost us so much money that this is just a drop in the bucket comparativly.
I can think of a million ways to use that much money to help people in Illinois who desperatly need it, but it's better that the ESA gets it, because the Gov. would just use it to line to pockets of his politically connected friends.
Politicians need to stop making flashy statements and start actually helping. This might have gotten him some good press for a few weeks, but it has actually hurt our state more then anything. The real depressing part is that I'm sure I'll never see this reported on the news because the press isn't interested in reporting all the news, only the traffic accidents and fires. Or bills being introduced to "fix" a problem that doesn't actually exist.

This makes me sad. As I was born in Chicago and I plan to go to college there in a couple of years, but I dont know if I want to live in the same state as these idiots.

Then again I do live in the same state as Ned Lemont and Joe Lieberman ; lol
