IEMA's Halpin Rips California's Yee Over Remarks

Last week, GamePolitics broke a story detailing California Assembly Speaker pro Tem Leland Yee's (D) plans to introduce legislation shielding college newspapers from faculty censorship.

Yee's bill was especially interesting in light of his status as architect of California's video game law, which currently faces a First Amendment challenge from the video game industry. The case should be decided sometime in May.

Over at 1UP, Luke Smith did some follow-up with Yee, asking for clarification on what at first glance might appear to be irreconcilable positions on a pair First Amendment issues.

"The difference," Yee told 1UP, "is that we are looking at children. And that's the major distinction. And what we are limiting with children are these ultra-violent video games. These kind of horrendous acts of violence that we are limited children's access to. That is the major difference."

Nor did Yee express confidence in the video game industry's ability to self-regulate.

"The Federal Trade Commission's undercover study (said) that nearly 70% of kids would be able to purchase an M-rated video game. More recently, the Harvard study says that the ESRB doesn't give accurate information," Yee remarked. "The content descriptor doesn't give accurate information about the material found within these games. The coup de gras was the 'hot coffee' incident where hidden sexual material was found in an M-rating game. It was failure upon failure of the ESRB to regulate itself that I felt I needed to step in..."

IEMA boss Hal Halpin was quick to issue a rejoinder, sending his comments to both 1UP and GamePolitics.

"It is unfortunate that Mr. Yee remains woefully uninformed regarding the FTC's findings with regard to voluntary retail efforts at self-regulation," Halpin said. "He is either quoting an out-dated several year-old study, or has missed the press regarding their latest findings: that the nation's leading retailers, our members, are successfully carding for M-rated games 65% of the time - which puts the games industry on par with his 'Gold Standard,' the movie theatre owners, who card at 69% of the time. While we appreciate Mr. Yee's convictions and his right to a perspective, we would appreciate an effort to, at the very least, represent the statistics correctly to his constituents. Misleading them must surely not be in anyone's best interests."

Halpin already owned Yee for Yee's lack of information.

That Harvard "study" was proven to be nothing more than nitpicking, no different than the PTC's own website, which lists everything that happens on every TV show.

Yee suffers from lack of logic, as the M rating is the equivalent of the R rating in movies, and if Hot Coffee was out in the open to begin with, there would be no issue.

I especially like this line:

While it is directed at Mr. Yee, bear in mind that I would include a great many legislators and individuals among those it could be spoken to. Certainly not the least of which would be the senator in Florida who not only misnamed a video game, but claimed it had already been released.

I use superlatives for the children.

They should test politicians voting on bills, if they do not know what they are talking about they get no say in the matter. I'm quite tired of voting for someone who has "my best interests" but has no idea what these interests are, or what the topic on the floor even deals with.

Secondly, the only one misinformed about the FTC's findings is you. The FTC found that close to 40% of the time retailers are still selling mature-rated games to minors. If Seven-11 had that failure rate on tobacco and alcohol, the CEO of that retailer would be in jail.

What you need to do, Hal, is stop lying about federal government findings. It catches up with you. You've been hanging around Doug Lowenstein too much. Jack Thompson

There are statistics too. A few (twenty) years ago, there was a lot of crime. And crime is bad. I choose to blame gamers for this crime even though I won't admit that video games even existed back then. What about today's crime rate you ask? Well sure it's gone down...hell, it actually started a major decline since the release of Doom, but that's not important information. What's important is all the info that pushes my narrow-agenda.
You should pity me because my goldfish has a hernia and it's all the gamer's fault. PITY ME OR I'LL SUE YOUR SORRY ASS!

I didn't get it at first. JT was posting boring shitty posts which failed to incite rage, sad little things that in the world of flaming are little more than a smoldering match-stick.

Meanwhile, Yee starts foaming at the mouth and mis-representing statistics by a generous amount. Some vigilant catholic read my letter and excorcised Mr. Thompson, but without any nearby pigs, the spirit infected the next most viable host, Leland Yee. Unfortunately, Thompson is still...well, you read his post, right? Yeah, even on his own without the Devil pulling the strings he is still not well.

Delving into Jack's mind

WARNING IF YOU ARE INEXPERIENCED WALKING THE PATHS OF INSANITY DO NOT READ, I DO NOT FEEL LIKE DRAGGING YOU BACK TO THE SANE.

Ok lets take a stroll into Jackland. As many of you have surmised JT has an obviously skewed view on reality. This comes from Jack's position beyond the boundaries of insanity. It's a relatively odd position one I have not recently seen.
Now let me give you my background. Many of you know the addage, there is a fine line between genius and insanity. Well this is essentially true, except, the genius is capable of crossing the line and coming back. Therefore for a short time the genius is capable of looking at the world from a different perspective, and bringing the gained knowledge back to the realm of insane and putting the pieces together.

ON to JT. Jack borders the districts of Narcissim, paranoia, obsessive compulsive, and schizophrenia. How he managed to find it I have no idea. Let's start with the last first and my belief the root cause of the insanity.
Schizophrenia is often accompanied by seeing or hearing voices. Here is where I think it started. JT in a rare moment stepped over the line of insanity, probably during the stress of failing his bar exam the first time or at some similar mentally stressful event. During this time JT was also seeking religion. JT heard a voice call to him, and JT followed believing a mere delusion to be God. Following the voice deeper into insanity JT crossed too far into the realms of insanity to come back on his on. Since he did not seek assistance at this point JT wandered aimlessly in insanity.

Secondly comes the most prevalent form of Insanity that haunts JT, Narcissim. Due to the delusional voice which JT hears he believes he is correct, about everything. He has placed himself in the center of a battle which he is only on the fringe. He self-inflates his own importance in any matter.

The Narcissim and the Schizophrenia have led JT down the path of the Obsessive Compulsive. JT has locked on to his target and it now must be destroyed. He no longer allows facts to get in his way. Why should he? He is always right. He must strike when ever where ever he can no matter how incidental. He must link any evidence no matter how insignificant to his cause.

Lastly and most recently JT has found a side trail of Paranoia. Since he must be correct, and he finds even the smallest evidence to support his beliefs, the overwhelmingly irreputable evidence against his evidence must be due to a grand conspiracy against him. Soon we'll see more evidence when the Grand conspiracy will be to attack him directly.

Unfortunately JT is now lost deep in the realm of insanity, his viewpoint is very skewed. Only an experienced traveller along the paths of insanity can even find JT, and I seriously doubt anyone has the strength and perserverence to guide him back to the sane.

Pixelantes and Hal Halpin, Who Is Just a Highly Paid Pixelante Lobbyist:

I am on Kansas television tonight and your're not. I'll be explaining to folks in Senator Brownback's homestate that some of the perps involved in the "Kansas Columbine" incited were found to be gamers by virtue of my close work with the law enforcement community there.

On the other side of the ledger, you have Hal Halpin, who spends days and nights doing whatever he can to make sure other parents' kids have access to violent video games that are mature-rated. If Hal Halpin really wanted to stop the sale of mature-rated games to kids he would stop agitating against legislation that requires a parent to make the purchasing choice.

See, Hal Halpin can't have it both ways, and maintain to the public that he is an honest individual. If the industry acknowledges that the mature-rated games are inappropriate for minors, then you can't also be for a scheme, as is Hal Halpin, that allows the sale of a mature-rated game to a kid with no parent in sight.

Either prohibit the sale of these games to kids, or stop pretending to want to stop the sales. The Federal Trade Commission repeatedly states that 35% or more of the kids who got to major retailers are able to buy these mature games. I am not sure if someone has ever mentioned it or not. Otherwise just see it as a reminder. We might want to try to collect money to take Jack to court or at least a formal cease and decist letter. This creep will never stop unless we do something about him, once and for all. He thinks that he can hide behind the law because he thinks we will never take him to court. More than 42% aren't being checked already, in regards to being pulled from the line and searched, which would be the more fitting comparison.

Why do they continue to try to bring up hot coffee as a means of saying the ESRB is "bad", 1st of all it's not the ESRB's fault that their ratings didn't include the hot coffee bit. 2nd no govenrment team, or any commitee would have found the hot coffee mini-game unless they had a team of hackers on them. However using hot cofee to take a shot at Rockstar is fair game (in fact I was surprised it didn't make MAD's 20 dumbest people events and things of 2005).

We included the rifle range because that is a basic and obvious part of military training; something a new recruit will immediately become familiar with. While the game introduces players to the look and procedures of marksmanship training, clicking a mouse is absolutely not applicable to actual marksmanship training.

When we qualify Soldiers as marksmen we send them to a rifle range. We put a rifle in their hands, not a keyboard and mouse. There are a lot of physical mechanisms entailed in mastering a firearm that cannot be replicated in a game. Indeed, there is no way that manipulating a keyboard and mouse, as players do in the Army's game, can provide vital cues on key elements of marksmanship such as trigger pressure, weapon cant and body position. In the Army, under the guidance of expert coaches, our Soldiers first learn how to align their sights. They then fire many rounds to become accustomed to the recoil of a rifle and to learn how to get a good sight picture.

Even today, in an age when computer games are ubiquitous, teaching rifle marksmanship is a major hurdle in basic training and a major element of Army refresher training for Soldiers in the force. If games taught Soldiers to become marksmen, Army training would be greatly simplified. However, games don't teach our Soldiers how to shoot so we train them with real weapons and ammo on real rifle ranges.

Games may simulate the real world but they do not recreate it. No one would believe that a child could master a racecar by playing a racing game. Likewise, clicking a mouse, as a player does in the Army game, will never teach a person how to shoot.
