Industry Reacts to Wednesday's Senate Hearing

GamePolitics broke the news about yesterday's Senate hearing... Well, actually we broke it back on March 14th, but nobody took much notice - then. Now it seems everybody's tongue is wagging over Wednesday's extravaganza chaired by Sen. Sam Brownback, seen at left (R-KS).

Sadly, GP wasn't able to catch the hearing (life... it is so annoying at times). In the meantime, we're dying to read the reports of those who sat in or listened to the webcast. MTV's Stephen Totilo will have something on it, for sure. Some GP readers have been posting what they heard in our comments area. And, hey, if anyone has an audio file, don't hold back...

What follows is a brief summary of written testimony submitted to the subcommittee by non-attendees...

Hal Halpin, IEMA (retailers): "The IEMA remains firmly committed to ensuring that children do not gain access to video games their parents deem inappropriate for them. But just as the Government has not and should not involve itself in determining what movies minors may watch and what music they may listen to, the Government should not decide what games they may play..."

Crossan Andersen, VSDA (video stores): "while we must oppose legal restrictions, the home video industry understands we have an important role to play in helping ensure that children do not gain access to videos and video games their parents deem inappropriate for them. VSDA and its members are committed to actively assisting parents in this regard."

Leland Yee, California Assembly: "In Ginsberg v. New York, the Court said, 'even where there is an invasion of protected freedoms, the power of the state to control the conduct of children reaches beyond the scope of its authority over adults.' ...And finally, just last year, the Supreme Court ruled in... Roper v. Simmons, that children are different in the eyes of the law because of brain development."

Oh, okay, so blacks should be different because their black and women should be different because their women, or is that what I'm getting from this quote?

Parents' jobs in raising their kids is to teach them the right and wrong and how the law percieves society, not the government. Children already don't have many of the freedoms and rights most people have anyway, so what difference does it make, or am I missing something here?

As far as I know, the only law in the video/movie/game industry that prohibits the sale of anything is porn to minors. I won't mention R rated movies because most minors can get into those anyway in some places or drag a parent.

As to the quote, no, I don't think you've quite got it.

It is pretty much agreed that children's brains are still developing. One of the problems with such an argument is that "brain development" occurs both physically and through stimuli (education, exposure to other individuals, all exposure to all forms of media (TV, movies, books, games, etc etc ect, and this over the ENTIRE life of the individual, not just one exposure). The stimuli continues until death. An individual's brain as stimuli is concerned never stops developing. Growth during childhood in the area of physical development is greatest and though growth continues in adulthood, it's no where near the level of development during the early stages of life.

The law isn't rational, whether relating to children or adults. There is no consistancy from state to state or from state to federal. Though you can point to some comparisons, many laws are sufficiently different to wonder if someone threw 100 sided die around to decide on the content of some laws. Age of consent, marriage laws for underage individuals, what is and what isn't statutory rape (differences in ages for victim and "attacker" as well as gender).

Truth is, we'll never have consistent, intelligent laws in this legal system. There's always the "unconstitutional" issue to be raised when an attempt to make laws make sense.

Maybe I'm just a cynic.

This habit of treating children without respect under the guise of protecting them is far too common.

Kids simply aren't as stupid as politicans seem to think. We've all been them and dealt with them, and we know it.

There are no laws stating that kids can not go into R movies. They have to be enforced by the people who sell tickets.

That kinda relates to the whole thing with whats going on here.


Government regulation isn't the way. If you want kids, then take care of it. Parents never make sure they can really handle the job of all jobs. They think they do, or just are looking for that "good time" and bam, the game begins.

We then turn to the higher power for help.

Example? Futurama. The episode where Bender became God for a short time.

Three Brillient Quotes

Is it just me or am them three quotes just perfect.

I mean - they all explain there points straight forward in two sentences. Anyone can understand them clearly, anyone who wants more information can look up the cases in the third quote for themselves.

The brain development quote is very...well put...But Brain development is something which can easily be changed, I remember watching a Documentary about the differences between male and female brain chemistry on the BBC a few months back. Hormones can change a brain which is more verbally aware into a more spacial aware brain very easily.

Just realised I missed a bit. The more visually aware brain is a male brain, and Testosterone can change the brain to be like that...

Testosterone is one of the chemicals related to aggression, and it is proved in tests that the brain reacts in the same way to virtual violence as real violence (not that this means anything about CAUSING violence .) Testosterone will be one of the chemicals released by the brain.

So playing hours, upon hours of violent videogames will slightly alter your brain chemistry making you Better at the game because you are more spatially aware.

What Dennis McCauley does not want you Taliban pixelantes to know is that Alabama's Steve Strickland hit it out of the park yesterday at the Senate hearing, identifying Grand Theft Auto's role in the death of three men, including his brother, in the cop-killing case featured on 60 Minutes. Didn't see any of you on that piece nor at the Senate hearing. But I did hear and see Steve Strickland thank me, twice, in his testimony, for my role in identifying the now proven role of the game in these deaths.

Oh, and here's another story Dennis McCauley doesn't want you to see, which appears in a Wisconsin paper this morning:

Can the "Bully" bring us together?

I'm sure uniting Madison liberals and the Christian right wasn't the idea behind a new video game called "Bully," in which the "hero" attacks classmates and teachers in a video revenge fantasy set at a reform school.

I learned about it from Dan Langlois, a Madison man who said the game's premise reminded him of the school massacres at Red Lake, Minn., and at Columbine High School in Colorado. In both of those cases, the real-life shooters got ready for their attacks by playing violent video games.

Take-Two Interactive, the same folks who brought you "Grand Theft Auto: Vice City," the game that makes stealing cars and killing cops a sport, are the geniuses behind "Bully."

"It's horrifying to me," said Langlois, a Madison father and grandfather. "Haven't they done enough?"

The game should be coming out soon, so Langlois has launched a campaign to keep "Bully" out of Madison.

Langlois wants the Madison School Board to go on record against the game, and ask Madison families not to buy it.

The resolution was written by Jack Thompson, a Florida attorney and "decency advocate" who has convinced the Miami-Dade School District, and several others, to pass similar measures. Thompson is probably best known as the Christian activist who helped push radio shock jock Howard Stern off the public airwaves.

Thompson said the issue of violent video games creates "strange bedfellows."

"I prepped Hillary Clinton on the issue," Thompson said.

He told Langlois that since Madison is such a liberal town, the anti-"Bully" crusade should have a good chance here.

Joanne Cantor, UW-Madison professor emerita and an expert on children and television violence, said she's glad Langlois is raising the issue here.

"Anything that creates a truthful debate on how these games affect kids is good," Cantor said. She said the new game might actually be worse than the notorious "Vice City" because it's set in a school, familiar territory for kids.

Cantor says that research shows that violent video games increase children's propensity for violence and increase their hostility levels.

"Most kids aren't criminally violent, but there are negative consequences that don't show up on the police blotter," she said.

Please read this carefully, my fellow gamers. DO NOT directly respond to Jack Thompson in ANY WAY. Every time you do, you prove him right.

Let me explain - he still is completely loony in many ways, but here is why responding to him here, or anywhere, is proving him right. Every time we respond to him with reason and legitimate arguments, what does he do? Ignores them. Not because he doesn't have an argument; he has his internal backward logic that proves him right in his own mind. Because he is not here to have a rational discussion. He disrespects gamers entirely too much to do that. He is here for one thing: to get ammo to use against us. Every response is ammo in his clip. He posts his phone number. Why? He wants people to call and "attack" him. So he can get bad press against us gamers. He knows we are, by and large, harmless. What matters to him, and why he continually posts insults here, is getting us discredited.

STOP talking AT him. If you feel compelled to respond to him, just respond '/signed' after every time he posts. That will be the same as signing this post. We are playing his game by responding to him. I refuse.

I am just as guilty as the next GPer, here. I for a long time, trolled him as his #4 fan. While being hilarious, it served little purpose - wit, humor and sarcasm are lost and wasted on him. Use our writing skills in a better manner. Write a letter to your Governor, Senators, Representative, or local officials. If you can't vote yet, ask your parents to co-sign a letter with you.

STOP feeding the troll. I know it's almost cliche at this point, but it's especially relevant now. A normal troll just gets his/her kicks by getting responses. Jack Thompson does this, too. But our responses prove him right, in his own mind, and give him ammo.

Jeff. I'd like to /unsign your previous post and refuse to /sign this one. You are now just copying and pasting this from other threads. I will respond to Jack's threads regardless of the effect, thank you for your time. You can refuse to play his games all you want, I for one enjoy intelligent conversation, and if one of his posts sparks that between legit members of the group I'll reply.

How the free speech value of video games is being debated by people who know nothing about video games...

Jack you should probably stop posting here. I will give you a list of reasons.

1. YOU ARE WASTING YOUR TIME. You don't really accomplish anything here, and you don't try to. All you do is make fun of how stupid everyone else is. Why don't you just let us be idiots in peace? We can't change your mind, and you can't change ours, so why don't you stop harrasing the website?

2. THIS SITE IS REALLY NOT THAT IMPORTANT. I like it, I think it's a really nice website, but I don't think it's actually damaging you in any way. If Dennis McCaulley is such a terrible journalist, then that makes him irrelevant. When you find a kook on the internet, you should just ignore them. This is such a waste of energy on something so unimportant.

Mr. Chairman and Other Distinguished Members of this Committee:

My name is Steve Strickland. I am one of three brothers of Arnold Strickland, who was a Fayette, Alabama Police Officer, who was murdered by a teenager on June 7, 2003. I was asked to come and testify by Senator Brownback’s office on how my brother’s murder has affected me and our family, the two other families who also lost their loved ones, and our entire community. Thank you for giving me this opportunity to do so today.

The best way to start is to start on that Saturday morning, a morning that changed all of our families’ lives. Arnold and I had plans for fishing that day. I was so looking forward to spending that time with him. We did not get to share as much time together as we would have liked because of my work as a minister. There was always something going on to keep us apart but not on that day. I was already on the water at daylight and waiting on him to get off work to come join me. It was going to be a fun day for the both of us. It was about 6:30 when that beautiful Saturday morning turned into one of the darkest days of my life.

My nephew Shane, one of Arnold’s three sons, called and asked if I had seen Dad. I said “No,” that I was waiting on his phone call to tell him how to get where I was. He was supposed to get off at six a.m. and should be here any minute. Shane said something had happened in Fayette and when he found out he would call me back. It was not 15 minutes when my phone rang again, and he said with tears in his voice, “You need to come home quick.”

I knew at that moment I would never see my brother alive again. Our fishing days together were over. I sat there and wept bitterly because I loved my brother deeply. As I got to the house there were family members already there along with police officers. It was total shock and confusion as to what had happened and what was going on. Being a minister I deal with death on a regular basis, but I had not experienced such trauma as I did that day. In the days ahead, we learned that Arnold along with two other men, one being James Crump, a fellow officer and the other Ace Mealer who was the dispatcher that night were also murdered. A young teenage boy named Devin Moore was responsible for the brutal execution of the three men that morning.

As days passed and then weeks, months and now years, our family is still trying to put our lives back together. No Saturday will ever be the same for me. No holidays will we enjoy as much as when Arnold was there. But what hurts the most is to see his grandchildren and knowing how much he loved them. They will never get to see him again. They will only hear stories and see pictures of their granddad. How do you explain to a child that just last week granddad was here and now he is gone and then the parents get to try to explain when asked, How did he die and why did he die?

The total impact on our families behind these senseless killings will never be over. This is the reason I accepted your invitation to come and speak today – so that maybe other families will not have to answer those hard questions and go through what our families are still going through to this day, trying to sort it all out. That brings me to the point of why I am here.

“Video Games”: What are they and how are they being used? The statement I made earlier about Arnold and the two others being executed was a very true statement. You see, they were not just shot; all three received a bullet to the head after they were on the floor. You have to ask the question what would bring a young teenage boy like Devin to this point.

Devin made a statement in a local newspaper one day that made no sense to me whatsoever, until it got in the hands of one of our attorneys, Jack Thompson, who knows all about what that statement meant: “Life is like a video game, everyone has to die sometime.” As a minister I deal with a lot of different issues and try to stay up and become educated on them but Jack opened up a whole other world to me that I did not even know existed. This is the violent video game world -- a world that, as far as I am concerned, is straight from the pits of Hell.

As I gather more information on the games and the people who call themselves “gamers,” I could see how someone like Devin, who at one minute did not put up any resistance when arrested for stealing a car or when being booked, to the next minute, getting my brother’s gun from him in the police station shooting him and then killing two other men in a matter of less then two minutes. A game such as Grand Theft Auto: Vice City could and did teach him how to do this. As I watched this game being played on CBS’s 60 Minutes, I could not believe my eyes as to how close in comparison this game was to the actual slaughter of my brother, along with James and Ace.

I had to ask myself the question: Why would someone put such games on the market and into the hands of teenagers? In Grand Theft Auto: Vice City, the people we put our faith and trust in to protect us from harm – the police officers – are the ones being targeted as the bad guys. Devin Moore practiced on this game hour after hour to kill our loved ones. It made him a more effective killer.

In this game, if you kill the police and other innocent people you win points. You get extra points for shots to their heads. When a society gets to the point to where law enforcement are the bad guys and the thugs and murderers are the good guys, our society will take a turn for the worse. Some have taken that turn. I do not believe most of us are ready for that. We have an opportunity to do something about this problem. Why don’t we? I am a man of facts. I try to live my life by them. Jack Thompson and others have facts and experts to back up what these games are: they are cop-killing simulators and they will bring more deaths in the future. Our loved ones in Fayette are not the only ones to die at the hands of teens who trained on this game to kill.

Let me remind you if I may: It could be one of your family members next. I ask that we put all the true facts on the table about how dangerous all of these murder simulation video games are.

The primary motivation for what these video game companies do in making and marketing violent games to kids is this: MONEY. Why would these companies want to change things? One day, we will all stand before the Almighty GOD and give an account for what we have done and what we have accomplished, both good and bad on this Earth.

I ask all of you Senators that we take a good hard look at the impact these games have on our teenagers and hold everyone accountable for their part. These games in the wrong hands played long enough are detrimental to our families, our friends, and our entire society.

Thank you for allowing me to share our grief, as well as our hope for a safer America.

Let's see...I went to work at 8AM CST this morning, for an hour and 45 minutes.

Then I took a test in American Military History from 1898 to Present.

Then I met in a group and talked about Facebook and MySpace in regards to Media Dependency in Human Communication, both the pros and the cons.

I then went back to work in the University Post Office, where in I make $5.15 an hour so I can feed myself and my Cat (Note, I work 15 hours a week, excluding class and homework time.), sorting, delivering mail to the library and tech center on campus.

I got off work at 4:30PM, came home, and cooked dinner as well as relaxed.

It's now 6:30PM CST, and I feel I've accomplished a lot today.

If my day is so full, and I got to bed at 11:30PM, and still have about three hours of course work to do, how does that translate into my playing video games like Katamari Damacy and Star Wars Battlefront 2 and going homicidal, like pundits say I will?

It doesn't.

Other then send out spam e-mails, and troll message boards, and stroke your ego, have you any time to do any actual work? Because God and Jesus know with my busy day, I don't have time to yell and scream at people who have done absolutely nothing earn or vindicate this type of disrespect.

But I guess, since I do own a console, I must automatically be a no-brained individual who practices devil worship while I claim Islamic jihad on a man that doesn't have any bearing on my life what so ever other then that he wishe to call me names?

Here's my real face, you know how to contact me when you wish to actually step out of that fantasy world you live in John Bruce. But then, that would take courage. And you seem to be lacking that.

There was nothing about this hearing in the USA Today, (New Orleans) Times-Picayune, (Thibodaux) Daily Comet, or The (Houma) Courier.

Not to mention that C-SPAN didn't bother to air the hearing live.

Indeed, another failed publicity stunt by Jack Thompson.
