Senate Subcommittee Holds Video Game Hearing

The video game/political axis shifts back to Washington, D.C. on Wednesday as a subcommittee of the powerful Senate Judiciary holds a hearing titled What's in a Game? State Regulation of Violent Video Games and the First Amendment

Sen. Sam Brownback (R-KS) chairs the Subcommittee on the Constitution, Civil Rights and Property Rights and will gavel the hearing to order at 2:00 P.M. Brownback, rumored to have 2008 presidential aspirations, is no stranger to video game content issues. As reported on GamePolitics last Decemeber, the conservative senator raised game industry eyebrows by urging retailers to display video game ratings, including ratings other than those of the ESRB.

Brownback is also a co-sponsor of Sen. Hillary Clinton's Children and Media Research Advancement Act (CAMRA), which calls upon the Center for Disease Control (CDC) to undertake a massive study of the effects of media on children. CAMRA was approved by the Senate's Committee on Health, Education, Labor and Pensions earlier this month.

Witnesses for the hearing are a varied lot and include speakers both pro and con with respect to video game content and First Amendment issues. They include:

Reverend Steve Strickland, brother of Fayette, Alabama Police Officer Arnold Strickland, who was murdered by "GTA killer" Devin Moore in 2003. Strickland is a plaintiff in an ongoing lawsuit against Sony, Take-Two, Wal-Mart and GameStop.

Elizabeth Carll, Ph.D., Chair of Interactive Media Committee, Media Psychology Division, American Psychological Association.

Dmitri Williams, Ph.D., Assistant Professor of Speech Communication University of Illinois at Urbana-Champaign

David Bickham, Ph.D., Research Scientist, Center on Media and Child Health, Harvard Medical School

Patricia Vance, President, ESRB

Rep. Jeff Johnson, Assistant Majority Leader, Minnesota House of Representatives

Attorney Paul Smith, partner, Jenner & Block LLP (has represented the industry in recent state-level First Amendment cases)

Kevin Saunders, J.D., Ph.D., Professor of Law, Michigan State University

California Assembly Speaker Leland Yee, whose appearance at the Game Developers Conference sparked controversy in recent days, was originally scheduled to testify at today's hearing, but an aide told GamePolitics that Yee was required for Assembly businss in Sacramento and will submit written testimony to the subcommittee instead.

maybe im just reading too much into it but devin moore is gonna pay for killing his brother so wouldnt that be enough for steve strickland but i'll just leave this entire thing alone as i dont want to offend anyone

Haha, and I realized that I've fallen quite aways behind on politics (the lure to just ignore everything and let someone else worry about it is so tempting. Especially when I have quite a few games that I need to finish, and all of this College homework. I know that it would be highly irresponsible to do so, though.); I had to double-check to be sure that Brownback was from my state.

Immediate News Release – March 29, 2006

Alabama Supreme Court Rejects Video Game Industry’s First Amendment Appeal in Cop-Killer Case

On November 3, 2005, Miami attorney Jack Thompson argued to an Alabama trial court that the First Amendment to the United States Constitution does not protect the marketing and sale of the violent cop-killing Grand Theft Auto games to minors. The trial court agreed with Thompson. The industry, including Sony and Take-Two/Rockstar Games, then took an emergency appeal to the Alabama Supreme Court. Yesterday, the Alabama Supreme Court rejected that appeal, and the case now proceeds to trial.

The plaintiffs—the families of two police officers and a dispatcher—are seeking $600 million in damages in this wrongful death lawsuit featured last year on CBS’ 60 Minutes, in the August 2005 Reader’s Digest, and in media around the world. Today, March 29, the above-pictured brother of Officer Strickland will testify before the US Senate about the video game-inspired triple homicide in Alabama.

This Supreme Court ruling also impacts favorably all of the video game industry-funded court challenges to recently passed state laws that seek to prohibit the sale of mature-rated violent games to kids. Thompson argued to the Supreme Court that the games are not even “speech,” and they are not.

The giant Philadelphia law firm, Blank Rome, which lost this panicked First Amendment appeal to the Alabama Supreme Court, has for eight months conducted an illegal assault upon Jack Thompson with a “shoot the messenger” strategy to try to win the case. Yesterday’s ruling cuts the legs off that criminal assault. Blank Rome would have done well to have focused more effort on the appeal than on its Mafia-style attack on Thompson, and the proof is in the Alabama High Court’s pudding. The counter-attack upon Blank Rome is about to begin, but not before another video game wrongful death case is filed in a matter of days against Take-Two and Sony arising out of other high-profile murders by a teen in another state after he trained on Grand Theft Auto to kill them.

Jack Thompson will be in Birmingham, Alabama on Friday, March 31, to explain to a gathering of politicians and conservative activists just how and why the video game industry, and the American entertainment industry as a whole, will shortly be on trial in a courtroom in Sweet Home Alabama. Enacted in July 2001, an Indianapolis, Ind., city ordinance required video game arcade owners to limit access to games that depicted certain activities, including amputation, decapitation, dismemberment, bloodshed, or sexual intercourse. Only with the permission of an accompanying parent or guardian could children seventeen years old and younger play these types of video games. On March 23, 2001, a three-judge panel of the Seventh Circuit Court of Appeals reversed and remanded the trial court's decision stating that "children have First Amendment rights." On Monday, October 29, 2001, the U.S. Supreme Court denied certiorari.

Interactive Digital Software Association, et al. v. St. Louis County, Missouri, et al., 329 F.3d 954(8th Cir. 2003)
St. Louis County passed an ordinance banned selling or renting violent video games to minors, or permitting them to play such games, without parental consent, and video game dealers sued to overturn the law. The Court of Appeals found the ordinance unconstitutional, holding that depictions of violence alone cannot fall within the legal definition of obscenity for either minors or adults, and that a government cannot silence protected speech for children by wrapping itself in the cloak of parental authority. The Court ordered the lower court to enter an injunction barring enforcement of the law, citing the Supreme Court's recognition in Erznoznik v. Jacksonville, 422 U.S. 205, 213-14, 45 L. Ed. 2d 125, 95 S. Ct. 2268 (1975) that "speech that is neither obscene as to youths nor subject to some other legitimate proscription cannot be suppressed solely to protect the young from ideas or images that a legislative body thinks unsuitable for them. In most circumstances, the values protected by the First Amendment are no less applicable when the government seeks to control the flow of information to minors."

What exactly are you accomplishing by coming here time after time when we've all made it crystal clear that we don't want you here. I'm still looking for the pro-video game faction in the list of people up there... The ESRB is not really the best pro-gaming organisation in the world, as their rating system is "limited" at best. I don't understand how GTA:SA and Warcraft 3 can both be rated M.

How do I know? My GF owns an anime store that she inherited fro mehr grandmother, and on more than oen occasion, because she's a woman and males try to take advantage of her, she's had to have them excorted off the premises by a police officer.
