Thompson Urges Injunction, Police Seizures of 25 to Life

Taking time off from his battles with the Florida Bar Association, Philadelphia law firm Blank-Rome, and, of course, satellite shock jock Howard Stern, Miami activist attorney Jack Thompson has returned to an old, familiar target, 25 to Life.

Eidos' cops-and-robbers shooter is due for release soon, with numerous sources reporting that 25 to Life has gone gold. Thompson's assault on the game comes in the form of a letter to California Attorney General Bill Lockyer in which he urges Lockyer to block the release of the game under the state's public nuisance law. Of perhaps more concern to civil libertarians, Thompson also offers an opinion that police officers can seize copies of the game without a warrant. The following passages are included in his message to A.G. Lockyer:

"Additionally, please know that California Civil Code Section 3495 enables and authorizes each and every law enforcement officer to walk into any video game store, without a court order, to seize and destroy each and every copy of 25 to Life. California law treats this as acceptable 'abatement' of a public nuisance by parties particularly endangered by such a nuisance."

"In the next six days I intend to take to the public airwaves in California, and to use other means, to encourage all law enforcement officers in California to in fact go into video game stores and seize all copies of 25 to Life.
"

GP: Last year there was talk of a pending civil suit against 25 to Life but Thompson hasn't mentioned taking such action this time around. We did confirm in September of 2005 that Concerns of Police Survivors (COPS), a national support organization for the families of slain police officers, was planning a suit against 25 to Life with Thompson as their lead attorney.

Lawsuits are one thing, but Thompson's contention that police officers can walk into retail stores and simply remove copies of the game is ludicrous. No rational police officer would take such an action as it would subject them to civil and criminal liability.

Thompson floated this idea to GP late last year. Frankly, we found it so off-the-wall that we declined to cover it at the time unless Thompson could indicate for the record that he had the backing of one or more actual law enforcement agencies or professional organizations. That information was not forthcoming. We are mentioning it now because Thompson has widely disseminated copies of today's letter to Attorney General Lockyer in which he advocates this police state tactic.

Jack needs to understand that you can't declare something a nuisance just because you don't like it. You also can't just go in and destroy copies of a game.

Dear Attorney General Lockyer:

Last year United States Senator Charles Schumer sounded the alarm that Eidos, Inc., located in San Francisco County, was set to release a violent “cop-killing” video game entitled 25 to Life. Senator Schumer called for the game not to be released.

Last year I appeared on CBS’ 60 Minutes regarding the murder in Alabama of two policemen and a dispatcher by a teen who trained on the cop-killing simulator Grand Theft Auto: Vice City. It appears that 25 to Life may be even worse in a number of regards than that Rockstar murder simulator linked to numerous murders. It is clear that this cop-killing simulator, 25 to Life, paints a bulls eye on the back of every law enforcement officer in California and across the country.

In the game, you can take the role of a gang member and rehearse, interactively, various methods of exterminating police officers for hours. The American Psychological Association in August of 2005 found that such “games” actually lead to increased aggression and violence.

It is just as obvious that this Mature-rated game will be widely sold to minors, who are particularly vulnerable, brain scans and other scientific/medical findings show, to copycatting the interactive violence contained therein. This is precisely why the Department of Defense uses these games to break down the inhibition to kill of new recruits.

US Senator Joseph Lieberman, with whose staff I have worked for years on this issue, proved this past December that these violent, Mature-rated games are sold to kids as young as nine years of age. This poses a particularly pernicious public safety hazard, as teenaged brains process this interactive violence in the sectors of the brain that lead to copycatting. Brain scan studies at Harvard prove this. They prove the danger.

As you know, this past year, you and a number of California District Attorneys used the public nuisance statutes in California to enjoin the hazardous practices of AutoZone. Eidos, Inc., poses just as great a public nuisance if it releases 25 to Life. California Civil Code Section 3479, et sequitur, gives you, as Attorney General of the State of California, all the authority you need to go into court on an emergency basis and enjoin the imminent release of 25 to Life. In my opinion, you must do just that.

I have available to you renowned experts, many of whom have testified before the United States Congress on the video game copycatting phenomenon, who can prove to a California court that this cop-killing simulator does in fact pose a demonstrable threat to the state’s law enforcement officers and is thus, by any definition, a “public nuisance.”

The video game industry’s hired guns have enjoined the enforcement of the video game law authored by Assemblyman Yee and signed into law by Governor Schwarzenegger. If your nuisance suit is successful, they will wish they had not done that, as then the entire nation will see that nuisance laws already on the books and held constitutional are more than adequate to stop the sale of violent, mature-rated video games to minors.

Your lawsuit to enjoin this nuisance could state as follows: The game, 25 to Life, is rated “M” (for mature) because it contains, as indicated by the label on the game itself “intense violence.” The industry, including Eidos, Inc., will not effectively restrict, however, the sale of this Mature-rated game only to adults. Indeed, Eidos, through the Entertainment Software Association (ESA) of which it is a member, has authorized ESA to assert in its court challenge to California’s video game law, that children have a constitutional “right” to buy mature-rated video games. In fact, such games are being marketed and sold to children through California. 25 to Life, a cop-killing simulator, will be no exception—by design. A company that will not restrict the sales of a Mature-rated game to adults only is engaged in, by definition, a public nuisance that constitutes a public safety hazard.

The foregoing is the reasoning behind a suit you could file. It is irrefutable. The need for it is inescapable.

I'd also like to add that it's probably Jack's intention to get some of the less civil and intelligent gamers to react violently to this, so he can go "See, I was right! Worship me!".

If I could prove that, I'd probably have a good case against Jack. Sending police officers into an area populated by people he "knows" are aggressive and violent? That'd makes him no better than what alleges the developers of doing. Of course, then I'd need to sound like I believe that shit, and I just couldn't do that. Not even to use against Jack.

This is the second letter sent by John Bruce Thompson clearly admiting that he lied to government officials when he told them that his stance was only to deny sales/rentals of games to minors. In his own words, he admits clearly a stance of BANNING entirely video games. More over, to have individuals enter a place of business and remove and destory video games to prevent them from being sold to ANYONE.

In my current state of anger, my first reaction would be to send a copy of his letter to the US Attorney General for possible charges of lying to members of congress. Similar to the potential charges that faced oil company execs last year. But, instead, I'm going to calm down, and continue to write my own statement to be distributed to the media and members of the government. Whether said statement is ignored, critized negatively, or applauded, does not matter in the end. I will have my say.

Why not do both? Make the statement AND send a letter to the US Attorney General. Attempt to get the public and the government involved in Jack (John)'s idiocy.

This particular type of game isn't my cup of tea (or coffee rather), but banning a video game all together is just ridiculous, aside from the shaky legal ground he's coming from. Heck, I'm not a lawyer and I can tell he's grasping at straws.

PARENTAL RESPONSIBILITY, JACK. Blame the parents who let their kids buy these things. Blame the stores who let children buy the games. Don't blame the game. By your own reasoning, we should blame Smith and Wesson if a child goes into a gun shop, bribes the store owner to buy a S&W rifle, and then kills someone. Why not blame the child's parents and the gun-store clerk? Because you're more likely to get a large cash settlement out of S&W.

Isn't the first time he's contradicted his alleged stance, and it won't be the last.

I really don't see how he could justifiy this. Supposedly he just wants adult games out of kids' hands, and this certainly qualifies as a game not meant for kids. Adult? That's debatable, especially since no one's played it yet, particularly, Jack. You'd think he'd want to look more credible by knowing more about that which he attacks, but maybe since that which he attacks has to be lied about to be worthy of being attacked, ignorance is bliss in this case.

Good job GP telling that this "thing" is really ludicris. Really, ripping games from the walls is unconstitutional. If you don't like the game, just ignore it and keep living your life. This game will never hurt anyone, so Jack Thompson should just be quiet instead of looking like an idiot.

California Civil Code Section 3495 enables and authorizes each and every law enforcement officer to walk into any video game store, without a court order, to seize and destroy each and every copy of 25 to Life.

This is total B.S, and unconstitutional. Maybe Jack Thompson should go on a field trip to Wasington D.S and actually READ the constitution! Get a life Jack Thompson and learn how to read! Next he will be taking down toys because they are too violent.

I never heard anything about the Public Nuisance law that allows parties to walk into private establishments and destroy their merchandise. By that logic, people should be able to walk into bars and destroy their liquor cabinets if the noise is too loud when the crowd lets out.

I don't think Jack really understands how laws work anymore.

The way you get something declared a nuisance is by filing a suit for injunctive relief, and the court decides, as a matter of law and as a matter of fact, whether the complained of product or activity constitutes a nuisance. California's statutes on this are particularly friendly to this approach in this instance. Those of you here who can read multi-syllabic words should actually read the nuisance statute in California.

Secondly, Dennis, since words actually mean something, I did not in the letter say that any particular law enforcement agency has committed to sending its officers into video game stores to seize the games. If you, Dennis, had bothered to read the statutory provision, you would find that that is PRECISELY what the law in California allows, whether you think it "ludicrous" or not. It is called "abatement of a public nuisance" by a citizen peculiarly harmed by that nuisance. It is specifically authorized by section 3495 of the Calif. Civil Code.

Dennis, you might want to stick with freelance journalism rather than with practicing law.

Finally, the thing that really annoys you children here is that somebody has a greater commitment to doing good than you do. Your are ashamed of your own laziness and apathy. If you don't like the increasing trouble that the video game industry is getting itself into, then get off your fat backsides and do something about it.

The only police officers that would follow this lame-brained idea are the ones that would walk into the store and take the game off the wall and destroy it and consider his job done. Not realizing, however I'm sure we all do, that the game on the wall is for display use and is empty. That's my vision of a Thompson follower a blind, deaf, mute, and ignorant puppet on a string. Jack, old buddy, I tried to listen to what you had to say. Originally you were out to stop the distribution of M/AO rated games to children, and I can sympathize with this I don't wanna see 10 year olds playing Grand Theft Auto or Manhunt or whatever, but there's a fine line between being a crusader for morality and being a total jerk, and mister you crossed that line quite a while ago. This is just one more way to be an arse, as far as I'm concerned. The gaming industry has done nothing to you, you were the one who struck first. Your 5 minutes of fame are almost over and your dragging it out by being a shit stirer. Jack you can't win, any tactician would tell you you've spread yourself out too thin by fighting multiple wars on multiple fronts and you've burnt most of your bridges behind you. Jack please just bow and leave the spotlight gracefully before the stagehands get the hook and drag you off.

Under section 3484, the stores that have their games seized (if they actually went out and did it) are entitled to sue the state for the value of the games.

So, essentially, the state would be getting the games off the shelves, by BUYING each and every copy of the game available.

3479. Anything which is injurious to health, including, but not limited to, the illegal sale of controlled substances, or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property, or unlawfully obstructs the free passage or use, in the customary manner, of any navigable lake, or river, bay, stream, canal, or basin, or any public park, square, street, or highway, is a nuisance.

Good luck convincing a court that this particular videogame, and only this game, is injurious to health...
