Alabama Update..... GTA Cop Killer Lawsuit....

Here's what we know:

- court will be in session at 1:30 P.M. Central, or about now...

- lots of media are present, including at least one TV crew from ABC affiliate Channel 33. That tells GP there's a good chance ABC Evening News may have something on this tonight...

- we haven't confirmed this yet, but the "300 page attack" that Jack Thompson referred to was described by one knowledgeable source as a defense rebuttal to Thompson's responses on the Pro Hac Vice motion by which the defense seeks to remove him from the case.

UPDATE: GP just spoke to an employee at the Fayette County Courthouse who told us that the Strickland case was still in court, and no one had emerged in the two-plus hours since it started. We're not sure what that might mean, but it could be good news for Jack Thompson in as much as the Judge didn't toss the case immediately. Stay tuned for updates....

NO NEWS YET but GP did stumble across this Tuscaloosa News piece from earlier today.

UPDATE / 7:03 Eastern: A source familiar with the case informs us that no rulings were made today, but that Judge Moore did seem "incredulous" over some things he heard about Jack Thompson. Still waiting for more info...

Fun until they start going 'comics code' with videogames and no stores sell games other then Pokemon. Everything I've ever enjoyed has come under fire for being evil and raping children. Video games, D&D, comics, internet, boobies, even mixed martial arts. it's getting retarded.

I was planning on having a prose-cleaning marathon on my novel tonight, but if Jack's position in the case is overthrown, I think I might squeeze in a few hours of "San Andreas" ;-)

As to why he is only sueing Sony and both Wal-Mart and Gamestop at the same time. The parties just listed might be the only one that was involved (according to JAcko) in this case. Moore said he played GTA 3 and Vice City. So my guess is he bought one from Wal-Mart and one from Gamestop, and if they were only the PS2 versions of the games that ties in Sony and not Microsoft and PC ect. See he is not sueing the companies, the families he represents are. So he can only bring up names that (in his opinion) were involved with moore. Remember the case is that did these games make Moore shoot the cops. So, if it wasn't a PC version of the game or what ever else, then they have no juristion to sue Mircosoft, PC companies, Target, or whatever. He just might not be addmitting this so he can go back later and get them in a different case. But if he brings it up now he knows that it will be dissmissed. Thats just how I, logically, figure it. But then again I am assuming Jacko has logic...

i dont think thats a theory. im pretty sure that is why he is so hell bent on fighting this case.

Let's say for a second Jack does win this thing. Then, hypothetically, let's say some troubled individual dressed up like Jack Thompson as "Banman" from the mod, and then re-enacted one of the missions, like trashing a GameStop or something. Since it was all Jack's "modest proposal" to make the game, couldn't GameStop (or whoever the victim might be) sue Jack for damages using his very own precedent?

I know it sounds incredibly stupid, but it makes as much sense as what he's doing right now...

I had hoped the people had made the mod featuring banman would have stuck to his script exactly as he wrote it and then include a scene at the end with Jack on trial for inspiring O.K. into doing all of the things he did.

As far as I'm concerned, none of these companies that are being sued never did anything wrong. Devon Moore was not a minor when he bought and played GTA, so they can't accuse Gamestop or Wal-mart for selling to a minor. It is the consumers responsibility to use their own discretion when playing video games. It makes sick to see so many things being wrongfully accused because so many people are irresponsible.

The Tuscaloosanews.com article mentions that during his criminal trial, Moore’s attorneys tried to claim that playing Grand Theft Auto influenced his actions.

So what if it did? Does influence supersede personal accountability?

I couldn't have hoped for a better reaction from the Judge.

Considering the fact that the Defense was detailing a "300 page report" of Jack's behavior, I think it's safe to say that Jack has already lost...

But I guess we'll just have to wait and see.

This isn't a bad thing, in fact since we know the Defense has submitted a "300 page report" of Jack's behavior, the most likely explanation for the case continuing is that the Judge wants to review all the material (no way would they have covered it all today).

Not always immediately. If the hearing finished today (it's possible they'll start up again tomorrow), it could be as much as a month before a ruling. A lot of the time, when it's very likely they'll be an appeal, these rulings are written, which of course takes time.

1. Skeptical; disbelieving: incredulous of stories about flying saucers.
2. Expressive of disbelief: an incredulous stare.

Sounds like Judge Moore doesn't believe whatever that 300 page attack on Jack Thompson said. So this would be a good thing for Thompson.
